College Brain — Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the website at collegebrain.ai and the services offered there (the "Service"), operated by College Brain ("College Brain," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you are under 18, you confirm that you have your parent's or guardian's permission to use the Service.


2. What College Brain is — and is not

College Brain is an informational tool that assesses your academic and extracurricular profile against publicly available data (such as the Common Data Set published by colleges) and provides estimates, comparisons, and guidance to support your college planning.

College Brain is not:

  • A guarantee of any admission outcome. Our probability estimates are informational ranges based on published data and modeling assumptions. They are not predictions, promises, or guarantees that you will or will not be admitted to any school.
  • A substitute for professional advice. College Brain does not replace a qualified school counselor, independent educational consultant, financial advisor, or attorney. For decisions with significant consequences, consult an appropriate professional.
  • Affiliated with any college or university. We are an independent tool. We are not endorsed by, sponsored by, or affiliated with any of the institutions referenced in the Service.

You acknowledge that college admissions decisions depend on many factors outside our data and modeling — including essays, recommendations, interviews, institutional priorities, and year-to-year variation — and that actual outcomes may differ substantially from any estimate the Service provides.


3. Eligibility

You must be at least 13 years old to use the Service. By using it, you represent that you are at least 13. If you are between 13 and 17, you represent that a parent or guardian is aware of and permits your use.


4. Your account

  • You are responsible for the accuracy of the information you provide.
  • You are responsible for keeping your login credentials secure.
  • You are responsible for activity that occurs under your account.
  • If you link a student and parent account, you authorize the sharing of information between those linked accounts as described in our Privacy Policy.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Provide false information about yourself or others
  • Attempt to access other users' accounts or data

  • Resell, redistribute, or commercially exploit the Service or its outputs without our written permission

We do not claim ownership of Your Content, and we do not sell it.

You are responsible for ensuring you have the right to provide any information you submit, including information about family members.


7. Our content and intellectual property

The Service — including its software, design, text, methodology, logos, and the "College Brain" name and "College admissions, decoded." tagline — is owned by College Brain and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission, except for your own personal, non-commercial use of the outputs you generate for yourself.


8. Third-party data and links

The Service relies on data from third-party sources, including federal databases and colleges' published Common Data Sets. We strive for accuracy but do not guarantee that all data is current, complete, or error-free. The Service may link to third-party websites; we are not responsible for their content or practices.


9. AI-generated content

The Service uses artificial intelligence to generate assessments, estimates, and guidance. AI-generated content may contain errors or omissions. You should review all AI-generated content critically and not rely on it as the sole basis for any significant decision. See Section 2 regarding the limitations of our estimates.


10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ESTIMATE OR GUIDANCE WILL BE ACCURATE OR LEAD TO ANY PARTICULAR OUTCOME.


11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COLLEGE BRAIN AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF — OR INABILITY TO USE — THE SERVICE, INCLUDING ANY ADMISSION OUTCOME, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


12. Indemnification

You agree to indemnify and hold harmless College Brain and its operators from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.


13. Changes to the Service and these Terms

We may modify or discontinue the Service at any time. We may also update these Terms; if we make material changes, we will notify you through the Service or by email before they take effect. Continued use after changes take effect constitutes acceptance.


14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, the provisions that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will continue to apply.


15. Governing Law and Dispute Resolution

15.1 Governing Law. These Terms and any dispute arising out of or related to them will be governed by the laws of the State of California, without regard to its conflict-of-laws principles.15.2 Venue. Except as provided in Section 15.3, any legal suit, action, or proceeding arising out of these Terms must be instituted exclusively in the federal or state courts located in San Mateo County, California. Each party irrevocably submits to the exclusive jurisdiction of such courts.15.3 Mandatory Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, including the determination of the scope or applicability of this agreement to arbitrate, will be settled by binding arbitration in [Insert City, e.g., Belmont], California.
